Apple have been granted a patent for 'adjustable headphones' - Linkage - seriously? You can move the sides up and down! Almost every pair of headphones I have owned have been adjustable!

Indeed. The patent system is severely broken, allowing Apple (and other companies) to lay claim to prior art. There's nothing in that article that describes exactly why their tech is new or innovative - the original point of the patent system, designed to protect someone's practical ideas/designs

And I wondered why the patent was awarded to Apple - until I looked up Beats to see who owned them...

Now hang on a minute!... I thought Apple were one of the companies honking-off about Lodsys doing the same kind of patent trolling!

Ugh.
This isn't really Apple's "fault", so much as it is the fault of a broken patent system. Still, this sucks.
This is why I love EA, despite the fact that I really dislike them for their tendency to purchase other companies and merge them into the EA label (as well as their tendency to release uninspired reboots of their most famous titles every so often).
EAs stance on patents and trademarks is like this: "we don't really release our source code, but we don't care what you do with our trademarked games."
Cases in point are Corsix TH, OpenNFS1 (IIRC this guy was even offered a position at EA Canada, which is really awesome - that's true appreciation!) and RunoUO (Not only are they allowed to provide the source for the emulator and have been since they started, but they're also allowed to host free shards!)
Projects like Project Dollhouse benefits from EAs attitude.
The antithesis to EA is Blizzard, which has a stupidly stupid history of suing anyone that so much as thinks about reverse engineering or using their trademarks in any way, shape or form.
